General Terms and Conditions of Sale – Souk A Can
Article 1 – Scope of application
These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all sales concluded between Souk A Can, a self-employed business registered under SIRET number 845 282 870, and any consumer or professional (hereinafter "the Customer") wishing to purchase the products offered for sale on the website www.soukacan.shop.
Any order placed on the site implies full and complete acceptance of these General Terms and Conditions of Sale.

Article 3 – Products
The products offered for sale are described and presented with the greatest possible accuracy.
However, minor differences may exist between the photos and the delivered product, particularly due to screen settings or manufacturing batches.
These variations shall not engage the seller's liability.
Article 4 – Price
The prices displayed on the site are in euros (€), including all taxes (TTC).
The delivery costs are specified at the time of ordering.
Souk A Can reserves the right to modify its prices at any time, without prior notice, but the products will be billed at the rate in effect when the order is validated.
Article 5 – Order
Any order validated by the Customer constitutes express and irrevocable acceptance of the prices and descriptions of the products.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order.
The order confirmation serves as proof of the transaction.
Article 6 – Payment
Payment is due immediately upon ordering.
The Customer can pay by credit card, PayPal, or any other secure method offered on the site.
Transactions are secured by an external payment provider; Souk A Can never has access to the Customer's bank details.
Article 7 – Delivery
The products are shipped to the delivery address indicated by the Customer when placing the order.
Delivery times are provided on the site for informational purposes only.
Any potential overrun shall not give rise to damages.
The risk of loss or damage to the products is transferred to the Customer at the moment when the Customer (or a designated third party) physically takes possession of them.
Article 8 – Right of withdrawal
In accordance with articles L221-18 to L221-28 of the Consumer Code, the Customer has a period of 14 calendar days from the receipt of their order to exercise their right of withdrawal, without having to justify their reasons or pay any penalties.
To exercise this right, the Customer must notify their decision to contact@soukacan.com.
The products must be returned in their original condition, unused and in their complete packaging.
The return costs are the responsibility of the Customer.
The refund will be processed within a maximum of 14 days from the receipt of the returned products, using the same payment method as that used during the purchase.
Exceptions to the right of withdrawal:
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for:
- Customized products or products manufactured according to the Client's specifications;
- Items that have been opened or used for hygiene reasons.
Article 9 – Legal Guarantee
The products sold benefit from:
- Regarding the legal guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code);
- Regarding the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).
In case of a defective product, the Customer must contact the seller at soukacan2@gmail.com to obtain the terms and conditions for return, replacement, or refund.
Article 10 – Liability
Souk A Can cannot be held responsible for indirect damages resulting from the misuse of the purchased product.
The Seller's liability is limited to the amount of the order.
Article 11 – Personal Data
The information collected on the website www.soukacan.shop is necessary for order management and business relations.
They are processed in accordance with the General Data Protection Regulation (GDPR).
The Customer has the right to access, rectify, and delete their personal data by writing to soukacan2@gmail.com.
No data is sold, rented, or transmitted to third parties without prior consent.
Article 12 – Intellectual Property
All elements present on the website www.soukacan.shop (texts, photographs, graphics, logos, videos, designs, site structure, database, etc.) are the exclusive property of Souk A Can, unless otherwise explicitly stated.
Any reproduction, modification, distribution or exploitation, in whole or in part, without the prior written authorization of Souk A Can, is strictly prohibited in accordance with articles L111-1 and L122-4 of the Intellectual Property Code.
Any violation of these rights constitutes an infringement, punishable by 3 years' imprisonment and a fine of €300,000 (Article L335-2 of the same code).
Souk A Can reserves the right to take any necessary legal action in the event of unauthorized use of its content (photos, texts, visuals or graphic elements).
Article 13 – Force Majeure
Souk A Can cannot be held responsible for any delay or non-performance due to force majeure (strike, natural disaster, pandemic, war, etc.) within the meaning of Article 1218 of the French Civil Code.
Article 14 – Applicable Law and Competent Jurisdiction
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute or complaint, the Customer shall first contact the Seller in order to seek an amicable solution.
In the absence of an agreement, the dispute will be submitted to the competent French courts in accordance with the rules of common law.
